　　I.Basicconditionsofemployer

　　一、用人单位基本条件

　　Theapplicantshallbeapartyandgovernmentorgan,publicinstitution,socialorganization,privatenonenterpriseunit,partnershipenterprise(accountingfirm,lawfirm,etc.)registeredintheadministrativeareaofthiscity,andshallcomplywiththeindustrialdevelopmentdirectionofthiscity,havearegisteredcapitalof1millionyuanormore,haveagoodreputation,operatenormallyinthiscity,paytaxesaccordingtolawAllkindsofenterprisesparticipatinginsocialinsuranceaccordingtoregulations(theregisteredcapitalofnonenterpriselegalpersonbranchesandtheirsuperiorlegalpersonsshallnotbelessthan1millionyuan).

　　申请单位应是在本市行政区域内注册登记的具有用人自主权的党政机关、事业单位、社会团体、民办非企业单位、合伙制企业（会计师事务所、律师事务所等）以及符合本市产业发展方向、注册资金在100万元人民币及以上、信誉良好，并在本市正常经营、依法纳税、按规定参加社会保险的各类企业（非企业法人分支机构其上级法人注册资金应不低于100万元人民币）。

　　II.BasicconditionsforReturnedStudents

　　二、留学回国人员应具备的基本条件

　　i.Theacademicdegreeobtainedbyreturnedstudentsshallmeetoneofthefollowingconditions

　　（一）留学回国人员获得的学历学位应符合下列条件之一

　　1.Theaccumulatedstudytimeabroadisgenerallynotlessthan1yearafterobtainingthedoctor'sdegreefromoverseasuniversities;ForgraduatesofthenatureofSinoforeigncooperationinrunningschoolsandjointtraining,thecumulativestudytimeabroadisgenerallynotlessthanhalfayear.

　　1、国（境）外高校学习获得博士学位，累计在外学习时间一般不少于1年；如为中外合作办学、联合培养等性质毕业生，累计在外学习时间一般不少于半年。

　　2.Obtainfull-timebachelor'sdegree,bachelor'sdegreeoraboveindomestic"doublefirst-class"constructionuniversities(thepostgraduatetrainingunitsdirectlyunderthecentralgovernmentandtheChineseAcademyofSciencesrefertothe"doublefirst-class"constructionuniversities),andstudyinforeignuniversitiestoobtainamaster'sdegree;Orobtainfull-timebachelor'sdegree,bachelor'sdegreeoraboveindomesticnon"doublefirst-class"universities,andstudyinhigh-leveluniversitiesathomeandabroadtoobtainamaster'sdegree;Orstudyinforeignuniversitiestoobtainbachelor'sdegreeandmaster'sdegree.

　　2、在国内“双一流”建设高校获得全日制本科、学士及以上学历学位（中央直属及中科院各研究生培养单位参照“双一流”建设高校执行），并在国（境）外高校学习获得硕士学位；或在国内非“双一流”建设高校获得全日制本科、学士及以上学历学位，并在国（境）外高水平大学学习获得硕士学位；或在国（境）外高校学习获得学士学位和硕士学位。

　　3.Studyinhigh-leveluniversitiesabroadandobtainabachelor'sdegree.

　　3、在国（境）外高水平大学学习获得学士学位。

　　4.Afterobtainingamaster'sdegreeoraboveinChinaorobtainingthequalificationforprofessionalandtechnicalpositionsatdeputyseniorlevelorabove,gotouniversitiesorscientificresearchinstitutionsabroadforfurtherstudyandbecomeavisitingscholarforatleastoneyear.

　　4、在国内获得硕士研究生及以上学历学位或取得副高级及以上专业技术职务任职资格后，赴国（境）外高校或科研机构进修、做访问学者等满1年。

　　5.OthersdonotmeettheconditionsinItems2and3,butstudyinforeignuniversitiestoobtainabachelor'sdegreeormaster'sdegree.

　　5、其他不符合第2、3项条件，但在国（境）外高校学习获得学士学位或硕士学位。

　　Theoverseasbachelor'sdegreereferredtoinItems2and3ofthisparagraphdoesnotincludetheformsofdomesticcollegestartingundergraduate,relevantnationalHigherEducationDiploma(HND),cooperativeschoolrunningandtransferofdomesticandplannedenrollment,andthecumulativelearningtimeabroadattheundergraduatestageisgenerallynotlessthan2years;Thecumulativestudytimeabroadatthemaster'sstageisgenerallynotlessthanhalfayear(excludingthecooperativeschoolrunningandtransfergradingformsofdomesticandoverseasenrollment);GraduatesofthenatureofSinoforeigncooperationinrunningschoolsandjointtrainingshallobtainbothdomesticacademicdegreesandoverseasdegrees.

　　本款第2、3项所指国（境）外学士学位，不含国内大专起点本科、有关国家高等教育文凭（HND）、国内计划外招生的合作办学及转学分等形式，本科阶段累计在外学习时间一般不少于2年；硕士阶段累计在外学习时间一般不少于半年（不含国内计划外招生的合作办学及转学分等形式）；如为中外合作办学、联合培养等性质毕业生，应同时获得国内学历学位和国（境）外学位。

　　Iftheoverseasbachelor'sdegreereferredtoinItem5ofthisparagraphisthehighestdegree,itdoesnotincludetheformsofdomesticcollegestartingundergraduatecourse,relevantnationalHigherEducationDiploma(HND),cooperativeschoolrunningandtransferpointsofdomesticandplannedenrollment,andthecumulativelearningtimeabroadattheundergraduatestageisgenerallynotlessthan2years.Ifthehighestdegreeisamaster'sdegree,theoverseasbachelor'sdegreemaynotbesubjecttotheaboverestrictions,andthecumulativestudytimeabroadatthemaster'sstageisgenerallynotlessthanhalfayear(excludingtheformsofcooperativeschoolrunningandtransferofstudentsenrolledoutsidethedomesticplan).

　　本款第5项所指国（境）外学士学位如为最高学位的，不含国内大专起点本科、有关国家高等教育文凭（HND）、国内计划外招生的合作办学及转学分等形式，本科阶段累计在外学习时间一般不少于2年。如最高学位为硕士的，国（境）外学士学位可不受前述限制，硕士阶段累计在外学习时间一般不少于半年（不含国内计划外招生的合作办学及转学分等形式）。

　　Afterbeingadmittedbyforeignuniversities,ifyouhavestudyexperienceindomesticcampusesorbranches,theaccumulatedstudytimeandcreditsobtainedabroadaregenerallynotlessthan50%ofthetotalstudytimeandcredits;Afterbeingadmittedbycollegesanduniversitiesabroad,ifyouobtaincreditsthroughnonacademiceducationinChinathroughsummervacation,theaccumulatedcreditsobtainedabroadaregenerallynotlessthan80%ofthetotalcredits.

　　被国（境）外高校录取后如在国内校区或分校有就读经历的，累计在外学习时间和获得的学分一般不少于总学习时间和总学分的50%；被国（境）外高校录取后如利用暑期等在国内通过非学历教育获得学分的，累计在外获得的学分一般不少于总学分的80%。

　　Domestic"doublefirst-class"universitiesshallbesubjecttothelistpublishedbythestate.Overseashigh-leveluniversitiespleasereferto（TimesHigherEducation）、（U.S.News&WorldReport）、（QuacquarelliSymondsWorldUniversityRankings）、（ShanghaiRanking’sAcademicRankingofWorldUniversities）Thelistoftheworld'stop500universitiespublishedshallbesubjecttothelistissuedafterconfirmationbyShanghaihumanresourcesandSocialSecurityBureau.

　　国内“双一流”建设高校以国家公布的名单为准。国（境）外高水平大学参考英国泰晤士报高等教育副刊（TimesHigherEducation）、美国新闻与世界报道（U.S.News&WorldReport）、QS世界大学排名（QuacquarelliSymondsWorldUniversityRankings）、上海软科世界大学学术排名（ShanghaiRanking’sAcademicRankingofWorldUniversities）发布的世界排名前500名高校名单，以上海市人力资源和社会保障局确认后发布的为准。

　　ThenameoftheinstitutionissuingthedegreecertificatespecifiedinthecertificateofforeignacademicdegreeissuedbytheMinistryofeducationshallprevailiftheoverseasstudentsstudyabroadtoobtainthedegree.

　　留学人员在国（境）外学习获得学位的院校以教育部出具的国外学历学位认证书中载明的颁发该学位证书的院校名称为准。

　　ii.ReturnedstudentswhoapplyforpermanentresidenceinShanghaishallmeetthefollowingconditionsatthesametime

　　（二）留学回国人员申办上海常住户口同时应符合下列条件

　　1、Studentsstudyingabroadshallcometothecityandcontinuetoworkinthecitywithin2yearsafterreturninghome,signlabororemploymentcontractswithrelevantemployersinthecityaccordingtolaw,andpaysocialinsurancepremiumsandindividualincometaxinthecityaccordingtoregulations(exceptthosemeetingthefirstparagraphofincentiveconditions).

　　1、留学人员应在回国后2年内来本市并持续在本市工作，与本市相关用人单位依法签订劳动或聘用合同、按规定在本市缴纳社会保险费和个人所得税（符合激励条件第一款的除外）。

　　2、Forthosewhomeetthefirstfourconditionsofthefirstparagraphofthisarticle,thesocialinsurancecontributionbaseinthesameunitforthelastsixconsecutivemonthsshallnotbelowerthantheaveragewageofemployeesinurbanunitsinthecityinthepreviousyear,andthepaymentofindividualincometaxshallbereasonablycorrespondingtothesocialinsurancecontributionbase;ForthepersonnelwhomeettheconditionsinItem5ofparagraph1ofthisarticle,thesocialinsurancepaymentbaseinthesameunitforthelast12consecutivemonthsshallnotbelessthan1.5timestheaveragewageoftheemployeesinurbanunitsinthecityinthepreviousyear,andthepaymentofindividualincometaxshallbereasonablycorrespondingtothesocialinsurancepaymentbase.Theannualpaymentbaseofsocialinsuranceduringthetransitionperiodshallbesubjecttotheofficialfigures.

　　2、符合本条第一款前4项条件的人员，最近连续6个月在同一单位社会保险缴费基数不低于上一年度本市城镇单位就业人员平均工资，个人所得税缴纳情况与社会保险缴费基数合理对应；符合本条第一款第5项条件的人员，最近连续12个月在同一单位社会保险缴费基数不低于上一年度本市城镇单位就业人员平均工资的1.5倍，个人所得税缴纳情况与社会保险缴费基数合理对应。社会保险缴费基数过渡期内每年的缴费基数以官方对外公布的数字为准。

　　Inprinciple,thesocialinsurancepaymentbase,periodandindividualincometaxpaymentareautomaticallycomparedbythesystem;Ifthesocialinsurancepremiumisnotpaidnormally,thepayerisinconsistentwiththeunitsigningthecontract,thethirdpartysuchasthenonactualemployerisentrustedtopay,andthesocialinsurancepaymentbasecannotreasonablycorrespondtothepaymentofindividualincometax,itshallnotberecognized.

　　社会保险缴费基数、期限及个人所得税缴纳情况原则上由系统自动比对；未正常缴纳社会保险费而补缴的、缴费单位与签订合同单位不一致的、委托非实际用人单位等第三方缴纳的、社会保险缴费基数与个人所得税缴纳情况不能合理对应的不予认可。

　　3、Returnedoverseasstudentsshallbetalentswhoareinshortsupply,urgentlyneedtoplayanimportantroleandneedtobeusedforalongtime.Theyshallsignalabororemploymentcontractwiththeunitaccordingtolaw.Thecontractshallbevalidfor2yearsormoreandshallbevalidfor3monthsormorefromthedateofonlineacceptance(ifthecontractstipulatesaprobationperiod,theycanapplyaftercompletingtheprobationperiod);Inprinciple,dispatchedpersonneldonotbelongtothescopeofbid.

　　3、留学回国人员应为单位紧缺急需并发挥重要作用、需长期使用的人才，与单位依法签订劳动或聘用合同，合同有效期在2年及以上，且自网上受理之日起有效期在3个月及以上（如合同约定有试用期的，需完成试用期后方可申报）；派遣人员原则上不属于申办范围。

　　4、Lessthanthelegalretirementageformorethanfiveyears

　　4、年龄距法定退休年龄5年以上。

　　5、InlinewiththecurrentfamilyplanningpoliciesofthestateandthisMunicipality.

　　5、符合国家及本市现行计划生育政策。

　　6、NocriminalrecordandothercircumstancesthatarenotsuitableforapplyingforpermanentresidenceinShanghai.

　　6、无刑事犯罪记录等不宜申办上海常住户口的情形。
